Legal

Terms

What SubSure provides, what it does not, and what stays your responsibility.

This page sets out the arrangement in plain terms. A full customer agreement is being prepared with Australian legal advice and will replace this page. Until then, if anything here matters to a decision you are making, ask us and we will answer directly rather than point at a clause.

What the service is

SubSure is a subscription platform for managing subcontractor compliance evidence. It collects documents from your subcontractors, extracts the values printed on them, records a person’s confirmation of those values, evaluates them against requirements you configure, sends renewal reminders, and retains the resulting history.

What the service is not

This is the part worth reading twice.

  • SubSure does not make anyone compliant. It records and evaluates evidence you and your subcontractors supply.
  • SubSure does not assume your legal, contractual or work-health-and-safety obligations. Deciding who may work on your site remains your decision.
  • SubSure does not verify a document with its issuer. It reads what the document says and applies your rules to it. It cannot detect a forgery.
  • SubSure does not advise on what your business should require. The baseline requirements are a starting configuration, not a legal recommendation.
  • SubSure is not a legal, insurance or accounting adviser.

Your responsibilities

  • Configuring compliance requirements that suit your business, and reviewing them as it changes.
  • Making sure the subcontractor details you enter are accurate — particularly mobile numbers, since that is how documents are requested.
  • Acting on what the register tells you. SubSure surfaces a status; it does not stop anyone entering a site.
  • Keeping your account credentials secure, and managing who in your organisation has access.

Your data

The records in your organisation’s account are yours. We hold them to provide the service. Personal information is handled as described in our privacy statement, which forms part of these terms.

You can export your compliance evidence. If you stop using SubSure, we will tell you how to retrieve your records before anything is removed.

Subcontractors

Subcontractors supply documents through a secure link and hold no account with us. You are responsible for having a proper basis to provide their contact details to SubSure and for the requirements you set for them.

Availability

We aim to keep the service available and to give notice of planned maintenance. SubSure is a working product under active development, and we do not offer a contractual uptime guarantee at this stage. Where a message fails to send or a document cannot be read, the product is designed to show you rather than hide it, and to leave a manual route open.

Fees

SubSure is provided on a subscription basis, priced by the number of subcontractors your organisation manages. Current pricing is confirmed with you before you subscribe.

Ending the arrangement

You can stop your subscription. We may end or suspend access for non-payment or for use that puts the service or other customers at risk. In either case we will tell you how to retrieve your records first.

Changes to these terms

We will update this page as the service develops, and will replace it with a full agreement once legal review is complete. Material changes will be notified to account holders rather than made quietly.
